Sukkur: A constitutional petition has been filed before the Sindh High Court, Sukkur Bench, challenging the Sindh government's June 30, 2026 order concerning the Health Department.
The petition was filed on behalf of a senior citizen through Advocate Shabbir Shar, a lawyer of the Supreme Court of Pakistan. During the preliminary hearing, the court issued notices to the Chief Secretary Sindh, Secretary Health, Director General Health Services Sindh, and the Chief Executive Officer of PPHI Sindh, directing them to submit their replies by August 4, 2026.
In the petition, Abuzar Ghaffari argued that the June 30 government order is inconsistent with the fundamental rights guaranteed to citizens under the Constitution. According to the petition, transferring a core public healthcare responsibility to a private NGO raises serious constitutional and legal concerns regarding access to basic healthcare, transparency, accountability, and the state's constitutional obligations.
The petitioner requested the court to examine the legality of the government's order in light of the Constitution and applicable laws. If found inconsistent with constitutional provisions, the order should be declared null and void to safeguard citizens' fundamental right to healthcare.
The future course of the case will be determined after the next hearing and the submission of replies by the relevant government authorities.
